Preparing a dossier does not open a case
The distinction matters. Sending allegations to the prosecutor, referring a situation and opening proceedings against a named individual are separate steps. The report does not establish that a submission has been made or that the ICC has accepted a jurisdictional basis.
Neither Israel nor Turkey is a party to the Rome Statute. A third country’s involvement would not automatically give the court jurisdiction: the alleged conduct would still need a qualifying legal connection or another applicable route, such as a UN Security Council referral.

US Treasury sanctions have identified Hamas financial facilitators operating in Turkey. Those designations provide relevant background, but do not establish Erdogan’s personal criminal responsibility.
